Terms of Service

6.1 Pricing

• All prices are displayed in Euros (€) and include applicable VAT where required
• Prices are subject to change; however, changes will not affect existing active subscriptions until renewal

6.2 Payment Processing

• Payments are processed securely by Lemon Squeezy (Lemon Squeezy, LLC)
• We do not store credit card or payment details on our servers
• By purchasing, you also agree to Lemon Squeezy's Terms of Service

6.3 Subscription Billing

• Subscriptions are billed annually in advance
• Your subscription will automatically renew unless cancelled before the renewal date
• You will receive a reminder email before renewal
• You can cancel auto-renewal at any time through your Lemon Squeezy customer portal

6.4 Failed Payments

• If a renewal payment fails, we will attempt to process it again
• After repeated failures, your license will be deactivated
• You may reactivate by completing payment manually

8.2 How to Request a Refund

Email refunds@fleetconnector.app with:

• Your order number
• The email address used for purchase
• Reason for refund (optional, but helps us improve)

8.3 Refund Processing

• Refunds are processed within 14 business days
• Refunds are issued to the original payment method
• Upon refund, your license is immediately revoked

8.4 Exclusions

Refunds may be denied if:

• The request is made after the 14-day period
• There is evidence of abuse, fraud, or violation of these Terms
• The same customer has previously received a refund for the same Product

8.5 Renewals

Renewal payments are non-refundable. You can cancel auto-renewal at any time to prevent future charges.

9.1 Scope of Support

During your active subscription, you are entitled to:

• Email support for installation and configuration issues
• Assistance with bugs or errors in the Product
• General usage questions

9.2 Exclusions

Support does NOT include:

• Customization or modification of the Product
• Support for third-party plugins, themes, or software
• Server configuration, hosting issues, or WordPress core problems
• Training or consulting services
• Support for Products used in violation of these Terms

9.3 Response Times

We aim to respond to support requests within 2 business days. Response times may vary based on volume and complexity.

9.4 Custom Development

Custom development services are available at additional cost. Contact custom@fleetconnector.app for inquiries.

10.1 Updates

During your active subscription, you will receive:

• Bug fixes and security patches
• Compatibility updates for new WordPress, WooCommerce, and third-party platform versions
• Feature improvements at our discretion

10.2 After Subscription Expires

If your subscription expires:

• You may continue to use the last version installed
• You will not receive further updates or support
• Your License Key will no longer validate, which may limit functionality

10.3 No Obligation

We are under no obligation to:

• Release updates on any specific schedule
• Maintain backward compatibility indefinitely
• Continue development of any Product

12.1 Exclusion of Damages

12.2 Liability Cap

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID TO FLEETCONNECTOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

12.4 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose.

14.1 Your Data

The Product processes data within your own systems (WordPress, WooCommerce). Order data, customer information, and delivery details remain on your servers and are transmitted directly to your connected services (e.g., Onfleet).

14.2 Our Access

FleetConnector does NOT:

• Access, store, or process your customer data
• Have access to your WooCommerce orders or customer information
• Store any data transmitted between your store and delivery platforms

14.3 License Validation

The only data transmitted to our servers is:

• Your License Key
• The domain where the Product is installed
• Plugin version (for compatibility purposes)

14.4 Your Responsibilities

You are solely responsible for:

• Compliance with GDPR, privacy laws, and data protection regulations
• Informing your customers about data processing
• Securing your own systems and data
• Ensuring lawful use of connected third-party services (e.g., Onfleet)

15.1 Integration

Our Products integrate with third-party services such as Onfleet, WooCommerce, and others. Your use of these services is subject to their respective terms and privacy policies.

15.2 No Responsibility

FleetConnector is not responsible for:

• The availability, accuracy, or performance of third-party services
• Changes to third-party APIs that may affect Product functionality
• Any damages resulting from third-party service outages or changes

15.3 API Changes

We make reasonable efforts to update our Products for third-party API changes, but cannot guarantee immediate compatibility with all updates.

16.1 Termination by You

You may stop using the Product and cancel your subscription at any time through your Lemon Squeezy customer portal.

16.2 Termination by Us

We may terminate or suspend your license immediately, without prior notice, if:

• You violate any provision of these Terms
• You engage in fraudulent or illegal activity
• Your payment method fails and is not resolved
• Required by law or legal process

16.3 Effect of Termination

Upon termination:

• Your License Key will be deactivated
• You must cease all use of the Product
• You must delete all copies of the Product from your systems
• No refund will be provided for termination due to breach

16.4 Survival

Sections relating to Ownership, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law survive termination.

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

18.2 Jurisdiction

Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of 's-Hertogenbosch, the Netherlands.

18.3 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory consumer protection rights under the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

18.4 Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr. We are not obligated to participate in ODR procedures.
